The rules for KoalaFix Solo early access and genuine business pilots, including fees, data choices, automated actions, beta status and ending participation.

These Early Access and Pilot Terms (Pilot Terms) apply when KoalaFix identifies an offering as Solo Early Access, a pilot, beta, preview, evaluation or similar pre-release program (an Offering).
They supplement the Terms of Service, Privacy Policy, and, where the participant is a business, the Data Processing Addendum. If these Pilot Terms conflict with the Terms of Service, these Pilot Terms control only for the Offering.
The sign-up screen, invitation or Order identifies the applicable Offering:
Solo Early Access is for individuals aged 18 or over using KoalaFix in a personal capacity. A Business Pilot participant must be authorised by the participating organisation.
Each participant must protect account credentials and use only devices, tenants and data they are authorised to use.
An Offering is pre-release and supplied for evaluation, learning and feedback. It may be incomplete, unstable, contain errors, change materially, or have features added or removed.
Participants must not rely on it for safety-critical or mission-critical activity. They must maintain appropriate backups and review material actions and outputs.
Solo Early Access currently has no fixed end date unless KoalaFix gives notice. A Business Pilot runs for the period and seats stated in its invitation or Order. If no period is stated, it continues until either party ends it under section 13.
The Offering is personal to the participant or named Business Customer and may not be resold, sublicensed or used for a third party without KoalaFix's written agreement.
An Offering is free unless its invitation or Order states a fee.
KoalaFix may offer a paid plan later. Before charging an existing free participant, KoalaFix will:
KoalaFix will not automatically charge a free participant merely because a notice or trial period expires. If the participant does not choose a paid plan, access may end or move to any continuing free tier described in the notice.
KoalaFix processes account data, usage events, diagnostic data, remediation events, crash and error information, device context and conversation content as needed to provide, secure, debug and support the Offering. The Privacy Policy explains the categories, purposes, disclosures and retention.
Diagnostic information can include file or folder paths, account or device identifiers, application state, and local network configuration. KoalaFix applies technical controls intended to remove detected secrets and minimise directly identifying information, but automated filtering is not perfect. Participants should not type passwords, payment-card numbers, government identifiers, health records or other unnecessary sensitive information into KoalaFix.
Core diagnostic and usage telemetry is integral to a free Offering and cannot be disabled while participating; stopping participation stops new collection.
KoalaFix may use aggregated or de-identified metrics to understand and improve the Service.
KoalaFix will not use raw Business Customer conversation content or Microsoft 365 content to train or improve a general or cross-customer model unless the Business Customer's administrator gives a separate affirmative opt-in.
For a free Solo Offering, use of conversation content and diagnostic data to improve KoalaFix's own models and the Service is a condition of participation, as described in the Privacy Policy. There is no opt-out while participating; ending participation stops new collection. Information already collected is retained and deleted under the Privacy Policy.
The Offering can perform automated actions under the Terms of Service. Depending on risk and configuration, an action may run automatically, require approval, or be blocked. Participants must read approval prompts, maintain backups, and stop using the Offering if its proposed action appears unsafe or unrelated to the issue.
KoalaFix may ask participants for feedback, interviews, diagnostic reproduction or usability information. Feedback is voluntary unless a Business Pilot Order identifies agreed evaluation activities.
KoalaFix may use feedback to improve the Service without payment. It will not identify a participant or use a Business Customer's name, logo, quote or case study publicly without permission.
The intellectual-property and Customer Output terms in the Terms of Service apply. Participation does not transfer ownership of Customer Data to KoalaFix.
Pre-release features, non-public documentation and test materials are KoalaFix Confidential Information. Customer Data and non-public information supplied by the participant or Business Customer are their Confidential Information. The confidentiality section of the Terms of Service applies.
This does not prevent a consumer from discussing their experience, making a complaint, obtaining advice, or exercising a legal right.
Support is provided on a reasonable-efforts basis through support@koalafix.com or as stated in a Business Pilot Order. No uptime or resolution service level applies unless it is expressly stated in an Order.
A participant may stop at any time by uninstalling the application and contacting support to close the account. A Business Customer may end its Pilot by written notice.
KoalaFix may suspend or end an Offering or a participant's access, acting reasonably, for breach, security risk, legal requirement, product discontinuation or material operational need. Where practicable, KoalaFix will give reasonable notice and an opportunity to export available data.
Ending an Offering does not convert it into a paid subscription. Data is handled under the Privacy Policy and, for a Business Customer, the DPA.
The Offering is pre-release. The warranty and liability sections of the Terms of Service apply, including all non-excludable rights under the Australian Consumer Law.
For a free Offering, the free-service liability cap in the Terms of Service applies. Nothing in these Pilot Terms excludes liability for KoalaFix's fraud, wilful misconduct, negligence causing death or personal injury, breach of confidentiality, or liability that cannot lawfully be excluded or limited.
KoalaFix may update these Pilot Terms. It will give reasonable notice before a material adverse change. A change introducing fees remains subject to section 5. A privacy change that requires consent will be presented as a separate choice.
These Pilot Terms are governed by the laws of Victoria, Australia, subject to non-excludable consumer rights.
