Pilot Program Terms.

The rules for the KoalaFix free pilot, including how your data is used, the beta nature of the Service, and liability.

01 · Overview.

These Pilot Program Terms ("Pilot Terms") govern your participation in the KoalaFix Pilot Program (the "Pilot"). They apply in addition to our Terms of Service and Privacy Policy. Where these Pilot Terms conflict with the Terms of Service, these Pilot Terms prevail for Pilot participants. By joining the Pilot, you agree to these Pilot Terms, the Terms of Service, and the Privacy Policy.

02 · Eligibility.

  • The Pilot is open to individuals aged 18 or over, using KoalaFix in a personal capacity.
  • You are responsible for the confidentiality of your account credentials and for all activity under your account.

03 · The Pilot.

KoalaFix is an Automated helpdesk that integrates with Microsoft 365 and performs automated remediation actions on your device. The Pilot provides access to KoalaFix for evaluation and feedback purposes. Pilot features may be incomplete, experimental, or change at any time.

04 · Free access.

  • The Pilot is provided free of charge for now.
  • The Pilot is currently offered free for a limited evaluation period (at present, 30 days from activation) after which your access may become read-only unless you choose a paid plan. Your data is retained, not deleted.
  • We may change the Pilot, introduce fees, or offer participants a paid plan in future, on reasonable notice. You are under no obligation to continue, and we are under no obligation to provide continued or paid access.

05 · Beta nature: provided "as is".

You acknowledge that the Pilot is a pre-release, evaluation version of the Service:

  • It is provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law.
  • It may be unstable, contain errors, or be modified, suspended, or discontinued at any time.
  • It is not intended for mission-critical or production reliance. Ensure important data is backed up before running any remediation.

06 · Data: a condition of participation.

This is the basis on which the Pilot is offered, so please read it carefully.

  • As a condition of free participation, you agree that KoalaFix collects and uses usage and diagnostic telemetry generated through your use of the Service (for example, remediation events, device-health snapshots, crash and error reports, usage events, session metadata, and assistant conversation content, including the transcripts of your fix sessions) to operate, secure, and improve the Service and our AI models, as described in our Privacy Policy.
  • What this data can contain. To make fixes debuggable, the diagnostic data we retain during the Pilot may include device-context details such as file and folder paths (with your device account name removed), device and workspace identifiers, and your device's local network configuration (network adapter, gateway, DNS, and proxy settings).
  • What we remove. Before storing this data we remove detected secrets (passwords, API keys, and access tokens) and email addresses.
  • No opt-out. Unlike paid subscribers, Pilot participants cannot opt out of this data use; it is the basis on which the Pilot is offered free of charge. If you do not agree, please do not join the Pilot. You may leave the Pilot at any time, which stops further collection.
  • Retention. We retain this data for the duration of the Pilot and delete it within 30 days of the Pilot ending.

All handling of personal information is governed by our Privacy Policy.

07 · Acceptable use.

You agree not to use the Service to violate any law; to process unlawful, harmful, deceptive, or abusive content; to infringe the intellectual property, privacy, or other rights of others; or to attempt to manipulate the AI into bypassing its safety features. You must not interfere with the Service, reverse engineer it, or use it to process data you do not have a lawful right to process.

08 · Automated system actions.

By participating, you consent to KoalaFix performing automated remediation actions on your device as described in our Terms of Service: for example, restarting Windows services, clearing application caches, modifying user-scope (HKCU) registry keys, removing stale credentials, deleting temporary files, and flushing the DNS cache. These actions may change how applications behave and may require you to sign in again. Ensure important data is backed up before running any remediation.

09 · AI disclaimer.

Outputs are generated algorithmically and may be inaccurate, incomplete, or unsuitable. You are solely responsible for reviewing and verifying outputs before relying on or acting on them. The Service does not provide professional IT, legal, financial, or medical advice and does not guarantee correctness.

10 · Intellectual property.

KoalaFix retains all rights, title, and interest in the Service, including its software, models, branding, and AI-generated outputs. You retain ownership of data you submit and grant us a non-exclusive, worldwide, royalty-free licence to use it to provide, secure, and improve the Service in accordance with the Privacy Policy.

11 · Your warranties.

You warrant that you have all rights, consents, and authorisations necessary to use the Service and submit the data you provide, and that your use of the Service will comply with these Pilot Terms and applicable law.

12 · Limitation of liability.

To the maximum extent permitted by law:

  • The Pilot is provided without warranty, and we are not liable for indirect, incidental, consequential, special, or exemplary loss, including loss of profits, data, goodwill, or business opportunity.
  • We are not liable for data loss, application instability, or system behaviour changes resulting from automated remediation. Ensure important data is backed up before use.
  • As the Pilot is provided free of charge, to the extent any monetary cap applies, our total aggregate liability is limited to AUD $100 (or, where the law does not permit liability to be limited to that amount, the lowest amount to which it can lawfully be limited).

Nothing in this section excludes, restricts, or limits any liability that cannot be excluded under applicable law, including the Australian Consumer Law.

13 · Australian Consumer Law.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Pilot Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or other applicable law.

14 · Term and termination.

  • You may leave the Pilot at any time by uninstalling the application or emailing support@koalafix.com.
  • We may suspend or end your participation, or the Pilot as a whole, at any time, acting reasonably (for example, for breach, security risk, or discontinuation of the Pilot). Where practicable, we will give reasonable notice.
  • On termination, your access to the Pilot ends. We handle your data in accordance with the Privacy Policy.

15 · Changes to these Pilot Terms.

We may update these Pilot Terms from time to time. Where changes are material, we will give reasonable notice by email or in-app notice. Continued participation after that date constitutes acceptance.

16 · Governing law.

These Pilot Terms are governed by the laws of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.
